ARTICLE 1: SCOPE

These general terms and conditions of sale apply to all sales made through the website https://mario-toy.com

ARTICLE 2: ORDERS

Automatic registration systems are considered as proof of the nature and content of the order. Mario Toy® confirms the acceptance of the order to the customer at the email address provided by the customer. The sale will be concluded from the validation by Mario Toy® of the payment of the order, i.e., from the date of validation of the payment for online orders paid by credit card or from the date of receipt of payment by check. Mario Toy® reserves the right to refuse or cancel any order from a customer with whom there is a dispute over the payment of a previous order.

ARTICLE 3: AVAILABILITY OF ITEMS

As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of consultation of the site by the customer remains dependent on the stock status at Mario Toy® and, of course, at the suppliers.

To create our showcase and sales catalog, we work with databases enriched based on information provided by our suppliers. This database contains more than a hundred items, not all of which are stored in our reserves, and our offer is therefore conditioned by the availability of the items from the suppliers.

Only the definitive discontinuation of an item by our suppliers leads to its removal from our sales offer. In other cases, a new order within a certain period remains possible.

When there is an unavailability of a product ordered, the customer is informed by email or on the invoice of the products shipped in the case of an order of several items.

Delivery deadline for the order: at the time of ordering and on the order acknowledgment, a delivery time is communicated to the customers. It is calculated by adding the availability time of the longest product to the delivery time of the transport method selected by the customer.

From the time of ordering to the shipment, the customer has the option to cancel their order.

Special features:

Pre-order items: items to be released are offered on the site https://mario-toy.com for pre-order. This reservation is made with the indication of a release date announced by the publisher at the time of opening the reservation phase. This release date may be changed at any time by the publisher who is solely responsible for the marketing of their product.

In all cases, Mario Toy® strives, from the date of final sale, to ship the items to customers who have reserved, up to the stock supplied by the publisher for the release day.

ARTICLE 4: PRICES

The prices indicated in euros are net, excluding shipping costs. This price includes the price of the products, handling, packaging, and preservation of the products. They are subject to change at any time without notice, knowing that the items will be invoiced based on the rate in effect at the time of order registration. All orders are invoiced in euros and payable in euros. Any customs duties or local taxes remain the responsibility of the recipient.

ARTICLE 5: SHIPPING COSTS

Shipping costs include a contribution to the costs of preparation, packaging, and postage. Remember to group all your items into one order. We cannot group two separate orders, and shipping costs will be charged for each one.

ARTICLE 6: PAYMENT

You have several payment methods offering maximum security guarantees. You can pay:

- By credit or private card (Visa, Eurocard/Mastercard) either directly on the site, in the payment form offered during the order process (secured entry by SSL encryption), by entering the type of card, the card number without spaces between the digits, the control number (located on the back of your card), and the validity date.

You have different payment methods and can even benefit from credit card payment facilities.

Payment is made on the choice of secure banking servers of our partners. This means that no banking information about you transits via the site https://mario-toy.com

Credit card payment is therefore perfectly secure; your order will be recorded and validated upon acceptance of payment by the bank.

ARTICLE 7: DELIVERY

We deliver to your home or to a relay point. The delivery time includes the time to prepare the package and the time of delivery. Mario Toy® delivers worldwide. The buyer is informed by email of the different stages of their order tracking: preparation and delivery.

The delivery time includes the preparation time and delivery ensured by our carrier. The announced delivery time of 10 to 20 days is valid from the receipt by the buyer of the delivery confirmation email. The delivery time (announced by the carrier) does not bind Mario Toy® for a longer period.

ARTICLE 8: WARRANTY - RETURNS - REFUNDS - WITHDRAWAL

The items supplied by https://mario-toy.com are new and guaranteed against any defect. They are identical to those of traditional commerce and come from all referenced publishers and suppliers.

If an item is defective or non-compliant, the buyer has 15 working days from the receipt of the items to request an exchange or a refund. If the 15-day period expires on a Saturday, Sunday, or a public holiday, it is extended to the next working day.

The customer must return the new or unused items in their entirety and in their original packaging, intact, accompanied by all possible accessories, instructions for use, and documentation (in its original cellophane packaging imperatively and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to contact@mario-toy.com (description and attached photos).

In the event of exercising the right of withdrawal, Mario Toy® is obliged to refund the amounts paid by the client, without fees, except for return shipping costs. The refund is due within a maximum of 14 working days from the date of receipt of the returned package(s).

Return shipping costs remain your responsibility.

In case of a refund, we guarantee it is made within 14 days or less from the date of receipt of the returned package. No return shipments will be accepted under any circumstances.

ARTICLE 9: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS

The transfer of ownership of the products to the buyer will only be realized after full payment of the price by the latter, regardless of the delivery date of said products. On the other hand, the transfer of risks of loss and deterioration of the products will be carried out upon delivery and receipt of the said products by the buyer.

ARTICLE 10: PROTECTION OF YOUR PERSONAL DATA

Mario Toy® is the producer and owner of all or part of the databases making up this site. By accessing this site, the customer acknowledges that the data composing it is legally protected and prohibits, in particular, extracting, reusing, storing, reproducing, representing, or retaining, directly or indirectly, on any type of medium, by any means and in any form whatsoever, all or part, qualitatively or quantitatively substantial, of the content of the databases appearing on the site to which they have access.

ARTICLE 11: RESPONSIBILITY

The descriptions of the products present in the databases of  https://mario-toy.com have been entered based on the information provided by the publishers. Mario Toy® is not responsible for the content of the works and cannot be held responsible towards the buyer. Mario Toy® cannot be held liable in the event of a force majeure event (strike, flood, fire, etc.).

The products offered comply with the Belgian law in force. Mario Toy® disclaims any responsibility if the delivered item does not comply with the legislation of the country of delivery (censorship, prohibition of a title or an author, etc.). Mario Toy® is not responsible for the content of the sites to which hypertext links may refer from its own site.

ARTICLE 12: APPLICABLE LAW

All the clauses in these general terms and conditions of sale, as well as all the purchase and sale operations referred to therein, will be subject to Belgian law.

ARTICLE 13: ACCEPTANCE OF THE BUYER

These general terms and conditions of sale as well as the prices are expressly agreed and accepted by the buyer, who declares and acknowledges having a perfect knowledge of them, and renounces, due to this fact, to take advantage of any contradictory document and, in particular, their own general terms of purchase, the act of purchase implying acceptance of these general terms and conditions of sale.
